Statutory Maternity Pay (SMP)

A legal payment from your employer for up to 39 weeks if you are an employee and you meet continuity of employment and average-earnings tests. It is not claimed from DWP.

How much you could get

SMP is paid at 90% of average weekly earnings for a short first period, then a standard weekly rate or 90% of earnings, whichever is lower, for the remaining weeks. Confirm the live standard rate on GOV.UK.

Who can claim

You usually need to be an employee, have worked for the same employer for a set period into the 15th week before the baby is due, and earn on average at or above the Lower Earnings Limit. You must give notice and proof of pregnancy as GOV.UK describes.

When it may not apply

Self-employed people and many people who recently changed jobs cannot get SMP and should check Maternity Allowance instead. SMP is not means-tested, but it does depend on that employment relationship.

How to claim

  1. Ask your employer, not DWP, for Statutory Maternity Pay. SMP is paid by the employer if you meet continuity of employment and earnings rules. There is no GOV.UK application form for SMP itself. Official page
  2. Give notice and proof of pregnancy as the official page describes. GOV.UK sets out when to tell your employer and what evidence they can ask for, such as a MATB1. Official page
  3. If your employer says you do not qualify, check Maternity Allowance. The two payments are alternatives for most people. Use the GOV.UK comparison, then claim MA from DWP if SMP is not payable.
  4. HMRC handles employer disputes about SMP. If you think SMP should have been paid, the official complaints route is on GOV.UK. Benefit Badger cannot contact your employer.
